Abstract
Durante l’Illuminismo, sostenendo la moderazione del regime penale e l’abolizione della pena di morte, il riformatore milanese Beccaria sfida la tradizione della giustizia patibolare come strumento di violenza legale nell’espressione dell’egemonia del diritto di punire. Con una risonanza cosmopolita, il suo progetto intellettuale delinea l’orizzonte di attesa dello Stato liberale per fondare la città politica giusta.
During the Enlightenment, promoting the moderation of the penal regime and the abolition of the death penalty, the Milanese reformer Beccaria challenged the tradition of scaffold justice as a device of legal and state violence for the punishing hegemony. With a cosmopolitan resonance, his intellectual project outlines the word to come for the liberal state and the human rights city.
